By accessing or using the StreamGist website and services ("StreamGist"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use StreamGist. Our Privacy Policy is incorporated by reference. We use a consent manager (Osano) for cookies; you can change choices anytime via the "Cookie settings" link in our footer.
StreamGist provides insights and analytics to help streamers make informed decisions about what games to play. The service leverages publicly available data from Twitch and game metadata from IGDB.com (Internet Game Database) to generate recommendations, rankings, and related content. You agree to use StreamGist responsibly, complying with all applicable laws and regulations. Outputs are informational only and not professional advice; you remain responsible for decisions made in reliance on them.
The Services may include paid demand tests, where a game studio pays to place a game in your recommendation feed so streamer interest can be measured. Paid demand tests are clearly labeled and kept separate from your organic recommendations. Paying does not change how organic recommendations are ranked, and every game still passes the same Twitch, fit, and quality checks.
To use certain features of StreamGist, you may be required to create an account. You agree to provide accurate information during registration and maintain the confidentiality of your login credentials.
All content provided by StreamGist, including insights, recommendations, reports, and original analytics, is owned exclusively by StreamGist and protected by copyright laws. You may use this content for personal and internal business purposes only. Redistribution, sale, or commercial exploitation is strictly prohibited without prior written consent.
However, you may display StreamGist insights in your own streaming, social, or promotional content, provided you do not sell, sublicense, or present them as your own analytics service. If you send ideas or suggestions, you grant StreamGist a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction.
To operate and improve the Services, and to create aggregated, de-identified insights that do not identify any individual, you grant StreamGist a non-exclusive, worldwide, royalty-free license to host, process, store, transmit, display, and create derivative works from content you submit, including processing by our sub-processors (e.g., OpenAI) under appropriate agreements.
You agree not to misuse StreamGist by:
Purchases of digital products (e.g., 3-day Boost Packs or time-limited access) are non-refundable once access is granted, to the extent permitted by law. This does not affect any non-waivable consumer rights you may have. If you experienced a purchase error or a technical issue that prevented access, contact StreamGist support through your account promptly (ideally within 24 hours) and we'll review case-by-case (no guarantee of approval).
We do not provide pro-rated or partial refunds for unused time once access has been granted.
Business and studio offerings, such as paid demand reads, may be provided under separate agreements that govern their pricing, delivery, and refunds.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT), TO THE MAXIMUM EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMGIST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR LOST PROFITS/REVENUE/GOODWILL.
OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID TO STREAMGIST IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. You will indemnify and hold StreamGist harmless from claims, damages, liabilities, costs, and fees (including reasonable attorneys' fees) arising out of or related to (a) your content; (b) your breach of these Terms; or (c) your use of the Services in violation of law or third-party rights.
This indemnity does not apply to issues caused solely by StreamGist or its service providers (e.g., errors in third-party data sources).
StreamGist integrates third-party services and data (e.g., Twitch, IGDB, Google Analytics/Tag/Consent Mode, Google reCAPTCHA, Stripe, OpenAI, DigitalOcean). We do not control third-party providers and their availability, policies, or accuracy may change. Your use of any third-party service may be subject to that provider's terms.
We reserve the right to suspend or terminate your access to StreamGist at our discretion if we believe you have violated these Terms of Use. We may also remove or disable content we reasonably believe violates these Terms or applicable law.
We may modify these Terms from time to time. Material changes will be notified by email and/or in-product notice; the "Last Updated" date will change. Continued use after the effective date constitutes your acceptance of the revised Terms.
You can access/update profile data in your dashboard and delete your account via our self-service tool. For privacy requests not available via the dashboard, contact StreamGist support through your account. See our Privacy Policy for your privacy rights (e.g., EU/UK and US state rights) and how to manage cookie consent at any time via the footer "Cookie settings" link.
These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law rules. If you are a consumer in a jurisdiction with non-waivable statutory rights, these Terms do not limit those rights. Nothing in these Terms deprives you of any mandatory consumer protections under the laws of your country of residence.
We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability. We are not responsible for delays or failures caused by events beyond our reasonable control.
The Services are not intended for children under 13 (or under 16 where applicable). Do not use the Services if you do not meet the age requirement. By using the Services, you represent and warrant that you meet these minimum age requirements.
